GENERAL CONDITIONS OF SALE

PREAMBLE

Any order placed on the website accessible at www.jetbooking.fr (hereinafter the "Site"), published by the company Jet Systems Hélicoptères Services, a public limited company registered at the RCS of Romans-sur-Isère under the number 342 910 882, having its registered office at Aéroport de Valence-Chabeuil, 26120 Chabeuil (hereinafter "Jet Systems") is subject to the present general terms and conditions of sale (hereinafter the "CGV").

 

ARTICLE 1 :  SCOPE OF APPLICATION

 

The GCV apply, without restCriction or reservation, to the performance of all the services offered on the Jet Systems Site (hereinafter the "Services") to all of its customers, natural persons (adults or minors accompanied by an adult) or legal entities that act for purposes that do not fall within the scope of their commercial, industrial, craft or liberal activity (hereinafter referred to as the "Client(s)").

The CGV apply to the exclusion of all other conditions, regardless of the medium, content and author.

The CGV express the entirety of the obligations of the parties. In this sense, Customers are deemed to accept them without reservation. The fact of placing an order on the Site implies the Customer's unreserved acceptance of the latest version of these CGV. The CGV may be subject to subsequent changes, the applicable version is the one in force at the date of the order and sent by email to the Customer after confirmation of his order.

The CGV are easily accessible at any time on the Site and will prevail, if necessary, over any other version or any other contradictory document.

The Customer certifies, after having read and accepted the CGV, to be of legal age or holder of an authorization to order the Services offered on the Site.

The Customer certifies having read the CGV before having definitively validated his order on the Site, and the CGV are binding on him in accordance with the provisions of article 1119 of the Civil Code.

ARTICLE 2 :  PRE-CONTRACTUAL INFORMATION

 

The Customer acknowledges having been informed, prior to the placing of the order and the conclusion of the contract, in a legible and comprehensible manner, of the General Terms and Conditions of Sale and of all the information listed in article L. 221-5 of the Consumer Code.

The following information is provided to the Customer by Jet Systems in a clear and understandable manner:

- the essential characteristics of the Services as well as the corresponding price ;

- all legal information specific to the nature of the Services;

- if applicable, any additional costs;

- the date or the deadline by which Jet Systems undertakes to deliver the Services to the Customer;

- information relating to the identity of Jet Systems, its postal, telephone and electronic contact details, those relating to legal guarantees and, where applicable, the existence and methods of implementation of guarantees and other contractual conditions;

- payment terms ;

- the procedures applied by Jet Systems for the processing of complaints.

ARTICLE 3 :  SERVICES 

 

Jet Systems presents on the Site the Services it offers for sale, as well as their detailed descriptions, offering the Customer the possibility to know before the final validation of his order, the essential characteristics of each Service he can order on the Site.

These indications are intended, without being exhaustive, to inform the Customer in the most complete way possible on the essential characteristics of the Services. The Customer is required to read them before placing an order.

The choice of a Service is the sole responsibility of the Customer. The photographs and graphics of the Services are presented on the Site for information purposes only and are not contractual. For any clarification regarding the characteristics of a Service, please refer to the details on the Site.

Jet Systems reserves the right to make any changes it deems necessary to its Services at any time, without obligation to maintain the Services previously made available to Customers. Jet Systems also reserves the right to modify its brochures or catalogs without prior notice.

Jet Systems reserves the right to modify the prices indicated at any time, without notice. The price applicable to the Service ordered corresponds to the price displayed on the Site at the time of final validation of the order by the Customer.

For the Panoramic Flight and Baptism of the Air offers, the E-tickets are not refundable but remain valid for 12 months from the date of purchase.

Jet Systems nevertheless offers Customers the choice of subscribing to one of the following Options.

 « ZEN » OPTION SOLD BY E-TICKET 

This option extends the validity of your E-Ticket by 6 months. Customers can also change the name of the beneficiary or receive a copy of an E-Ticket in case of loss.

This option is available in the shopping cart.

 « ZEN + » OPTION SOLD BY E-TICKET

The « Zen + » option allows you to reimburse your E-ticket if it is not used during its validity.

All requests for reimbursement must be made using a reimbursement form (in Annex 1) to be completed and sent by registered mail with return receipt to the following address:

The costs incurred for the purchase of this option are not refundable. Only the price of the flight will be refunded. The refund will be made according to the means of payment used.

ARTICLE 4 :  ORDERS

 

Once validated, the order will be confirmed by sending the Customer an order confirmation by email, which will be accompanied by the sending of the CGV in PDF with the invoice for the Services.

4.1 Prior identification of the Customer

4.1.1 Customer who already has a personal account

The Customer who already has a personal account on the Site must identify himself in the part of the Site reserved for this purpose by indicating the e-mail address he has previously communicated to Jet Systems as well as the password that the latter has assigned to him.

Once identified, the Customer accesses his personal account and can begin to select the Services he wishes to order. If the Customer loses his password, he clicks on the "Forgot your password?" tab and enters his email address. His password will be automatically sent to his e-mail address.

4.1.2 Customer without a personal account

Customers who do not already have a customer account on the Site and who wish to place their first order on the Site must fill out a registration form online, filling in all the mandatory fields marked with an asterisk.

The Customer agrees to provide accurate and sincere information. The information provided by the Customer when creating the account is binding. Jet Systems can not be held responsible for the impossibility in which it could be to fulfill its obligations, in case of error of the Customer, including in the wording of the recipient of the order.

Once the form is completed and validated, the Customer can begin to select the Services he wishes to order.

4.2 Placing and confirming the order

4.2.1 Choice and availability of Services

The Customer places his order from the Services presented on the Site. It is up to the Customer to select the available Service(s) that he wishes to order in accordance with the indications appearing on the Site.

The offers of Services are within the limits of the possibility of their realization by Jet Systems in accordance with the indications which will appear on the Site at the time of the placing of the order.

4.2.2 Shopping Cart Consultation

Once the Services have been selected, the Customer can check the contents of his order, in particular the number of Services, the unit price and the total price by clicking on the "My Cart" link. 

The Shopping Cart also allows the Customer to view the Services, as well as all of their characteristics, prices and terms and conditions of availability. The Customer will have the possibility to withdraw one or more Services. The order can be modified at any time before its final validation. It will be definitively registered only after the various information has been filled in and payment has been made online.

4.2.3 3 Order Confirmation

Before confirmation of the order, the Customer clicks on the button "I have read and I accept the general conditions of sale", and thus declares to fully and unreservedly accept this order as well as all of the CGV.

The Customer will finalize his order, by proceeding to his payment. Any validated order implies in particular acceptance of the price corresponding to the Services ordered. The order will only be final upon payment of the corresponding price. The Customer guarantees that he is fully authorized to use the credit card for the payment of his order and that these means of payment give access to sufficient funds to cover all the costs resulting from orders placed on the Site.

4.2.4 Confirmation of the sale by Jet Systems

Once the order has been validated and the payment made, the Customer will receive an acknowledgement of receipt of his order at the e-mail address he has provided. This acknowledgement of receipt states the amount invoiced, the list of Services, the deadline and the terms and conditions for making them available, the present conditions, as well as the standard withdrawal form.

The Customer acknowledges that the order registration systems are proof of the purchase and its date.

4.3 Modification or resolution of the order

In the event of unavailability of the Service after the confirmation of the order by Jet Systems, the Customer will be informed by e-mail of the cancellation of his order. In this case, the Customer has the option of (i) ordering a Service of equivalent quality and price within the limits of the Services offered, or (ii) being reimbursed for the price of the Service ordered within 30 days of his request.

Any abnormal or bad faith order, any fraud or attempted fraud, any incident of payment of the price of an order may result in the deletion and/or deactivation of the customer account concerned and/or the refusal of the order.

4.4 Proof of order

The computerized records, stored in the computer systems of Jet Systems in reasonable conditions of security, will be considered proof of communications, orders and payments between the parties. The archiving of orders is made on a reliable and durable medium.

 

 ARTICLE 5 : PRICE

 

The prices of the Services are indicated in euros All Taxes Included (VAT included), excluding participation in any processing costs. The amount of processing fees will, where applicable, be calculated automatically based on each order; it will appear on the summary of the Customer's order before final registration. In addition, once the order has been validated, the prices and costs are confirmed in the confirmation email sent to the Customer.

 

The Services will be invoiced based on the rate in force at the time of the final validation of the order. At no time can the sums paid be considered as a deposit or down payment.

 

If one or more taxes or contributions, in particular environmental taxes, were to be created or modified, either upwards or downwards, this change could be reflected in the selling price of the Services.

 

The prices indicated on the Site may change at any time, particularly in the case of special offers or sales. In the event that the price of a Service is not determined in advance, or where an exact price cannot be provided, Jet Systems will provide the Customer with a pricing method or detailed quote.

 

ARTICLE 6 : TERMS OF PAYMENT

 

 The payment of the orders is carried out on line, by bank card (Visa, MasterCard and other blue cards).

The Customer's credit card will be debited at the time of validation of the order.

 

The Customer undertakes to have all the necessary authorizations for the use of the bank card intended for the payment of the order on the Site.

 

The Site is subject to a security system: the "Secure Payment" page details the security features of transactions made on the Site.

 

ARTICLE 7 :   DELIVERY OF SERVICES - DELIVERIES

 

The delivery of the Services is understood to be their realization by Jet Systems. It will only occur after confirmation of payment by Jet Systems' banking institution.

Jet Systems undertakes to make its best efforts to perform the services at the time and on the day agreed with the Customer. However, these indications may change due to conditions prevailing at that time and day. If the date of realization is postponed to a delay superior to five (5) days, for any other cause than the force majeure or the fact of the Customer, the order will be able to be cancelled at the written request of the Customer under the conditions envisaged in the articles L. 216-2, L. 216-3 and L. 241-4 of the Code of the consumption. The sums paid by the Customer will then be restored to him at the latest in the fourteen (14) days which follow the date of denunciation of the order, with the exclusion of any compensation or withholding.

To take advantage of the Services, the Customer must arrive at the meeting place agreed with Jet Systems 20 minutes before the scheduled take-off time, with their E-Ticket and, if applicable, with the exchange voucher or the relevant gift voucher.

 

Jet Systems expressly informs the Customer that the presentation of an identification document is mandatory for any person entering its premises. Without the presentation of one or more of these documents, Jet Systems reserves the right to refuse the passenger boarding the helicopter. 

Jet Systems also informs the Customer that the tours presented at the time of booking are subject to change due to weather conditions.

Jet Systems offers home delivery of gift bags related to the Services. The delivery is made to the delivery address indicated by the Customer.

Delivery is made by La Poste via Lettre suivie, delivery service with tracking, delivered without signature. Jet Systems can provide the Customer with the tracking number by email.

For purchases of E-tickets, upon receipt, the Customer will contact the reservation center of Jet Systems at 0 892 494 494 (0.40 € / min + price of a local call) or by mail to info@jetbooking.fr to arrange an appointment to enjoy the Service purchased.

For purchases made on the site of one of Jet Systems' partners, the appointment must be made with the partner concerned. Jet Systems will then validate the Customer's request. Following this validation, an e-mail will be sent to the Customer with an E-ticket to be presented on the day of the flight (in paper or electronic version).

 

ARTICLE 8 : CANCELLATION OF SERVICES - FORCE MAJEURE

 

For reasons beyond its control, Jet Systems reserves the right to cancel and/or postpone the Services at short notice. In this case, Jet Systems will not be liable for any transportation, lodging and food expenses incurred by the Client to get to the site.

All Clients are informed that the flight schedule may be modified due to weather, aerological or technical conditions that may affect the safety of the flight, either by restriction, modification or prohibition of the airspace. For shared flights, a minimum number of passengers is required, which may be 4 or 5 depending on the aircraft. The Customer will be informed as soon as possible of these possible changes.

 

The parties shall not be held liable if the non-performance or delay in the performance of any of their obligations, as described in the GTC, results from a case of force majeure, as defined in Article 1218 of the Civil Code.

 

Given the nature of the Services offered, the parties expressly agree that any event, particularly meteorological, which would jeopardize the performance of the services under the usual security conditions will be considered as a case of force majeure within the meaning of the provisions of Article 1218 of the Civil Code.

 

 

ARTICLE 9 : RETRACTATION

 

The Customer declares to have read the provisions of Article L. 221-28, 12° of the Consumer Code, under which the right of withdrawal is notably excluded for the provision of accommodation services, other than accommodation. residential, goods transport services, car rental, catering or leisure activities which must be provided on a specific date or period.

 

ARTICLE 10 : LIABILITY - WARRANTY

 

Jet Systems cannot be held liable in the event of delay or suspension of the Services for reasons beyond its control or attributable to the Customer, as well as in the event of force majeure as defined by article 1218 of the Civil Code.

 

Jet Systems can only be held liable in the event of fault or negligence on its part, proven by the Customer. In any case, the responsibility of Jet Systems will be limited only to the certain, direct and personal prejudice, the proof of which will have been previously reported by the Customer.

 

In accordance with the applicable legal provisions, Jet Systems provides the legal guarantee of conformity of the Services provided on the Site. Unless expressly agreed in writing with the Customer, Jet Systems does not provide a commercial guarantee within the meaning of the provisions of article L. 217-15 and following of the Consumer Code.

 

ARTICLE 11: PROTECTION OF PERSONAL DATA

 

As part of the creation of the customer account and the execution of the order, information and data concerning the Customer are collected. Pursuant to Law 78-17 of January 6, 1978 as amended by Law No. 2018-493 of June 20, 2018, it is recalled that this data is necessary for the management of orders and commercial relations. They may be transmitted to companies that contribute to these relations such as those responsible for the execution of Services and orders for their management, execution, processing and payment.

The information and data collected are also kept for security purposes, in order to comply with legal and regulatory obligations as well as to improve and personalize the services offered and the information sent.

In accordance with the national and European regulations in force, the Customer has a permanent right of access, modification, rectification, opposition, portability and limitation of the processing of information concerning him.

This right can be exercised by writing to Jet Systems indicating your name, surname, e-mail, address and, if possible, your customer reference, at the following address: rgpd@m2h.fr

 

The information held by Jet Systems may not be transferred to a company headquartered in a country that does not guarantee the same level of security and confidentiality as that required in the European Union.

 

The Jet Systems file containing the personal data of the Customers has been declared to the Commission Nationale Informatique et Libertés (CNIL). The declaration number is [ In process of request].

 

ARTICLE 12 : INTELLECTUAL PROPERTY

 

The content of the Site is the property of Jet Systems and its partners and is protected by French and international laws relating to intellectual property.

 

Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an infringement.

 

ARTICLE 13 : DISPUTE – APPLICABLE LAW – JURISDICTION

 

All claims must be sent to Jet Systems by registered mail with return receipt within 10 days from the date of performance of the Service at the origin of the dispute. After this period, no claim will be admissible. Claims should be addressed to :

In the absence of amicable settlement, the Commercial Court of Romans is solely competent to decide all disputes between Jet Systems and the Customer, including in cases of multiple defendants, connexity or intervention. The CGV and the orders resulting from them are subject to French law.

If any clause or provision of the CGV is invalidated or declared illegal by a final court decision, such invalidity or illegality shall not affect the remaining clauses and provisions, which shall continue to apply.

The fact that Jet Systems does not avail itself at a given time of one of the clauses of the CGV, can not be interpreted as a waiver to avail itself later.
