PREAMBLE
 
Any order placed on the website accessible at the address www.jetbooking.fr (hereinafter the “Site”), published by the company Je  Systems Hélicoptères Services, a limited company registered with the RCS of Romans-sur-Isère under the number 342 910 882, having its head office at Valence-Chabeuil Airport, 26120 Chabeuil (hereinafter “Jet Systems”) is subject to these general conditions of sale (hereinafter the “CGV”).

ARTICLE 1: SCOPE OF APPLICATION

The General Terms and Conditions apply, without restriction or reservation, to the provision of all the services offered on the Jet Systems Site (hereinafter the “Services”) to all of its customers, natural persons (majors or minors). accompanied by an adult) or legal entities which act for purposes which do not fall within the scope of their commercial, industrial, artisanal or liberal activity (hereinafter referred to as the “Client(s)”).

The General Terms and Conditions apply to the exclusion of all other conditions, regardless of the medium, content and author.

The General Terms and Conditions express the entirety of the obligations of the parties. In this sense, Customers are deemed to accept them without reservation. Placing an order on the Site implies the Customer's unreserved acceptance of the latest version of these General Terms and Conditions. The General Terms and Conditions may be subject to subsequent modifications, the applicable version is that in force on the date of the order and sent by email to the Customer after confirmation of their order.

The General Terms and Conditions are easily accessible at any time on the Site and they will prevail, where applicable, over any other version or any other contradictory document.

The Customer certifies, after having read and accepted the General Terms and Conditions, that they are of legal age or have authorization to order the Services offered on the Site.

The Customer certifies having read the T&Cs before having definitively validated his order on the Site, and the T&Cs are enforceable against him in accordance with the provisions of article 1119 of the Civil Code.

ARTICLE 3: SERVICES

Jet Systems presents on the Site the Services that it offers for marketing, as well as their detailed descriptions, offering the Customer the possibility of knowing before the final validation of his order, the essential characteristics of each Service that he can order on the Site.

These indications are intended, without being exhaustive, to inform the Customer as completely as possible on the essential characteristics of the Services. The Customer is required to read it before placing an order.

The choice of a Service is the sole responsibility of the Customer. The photographs and graphics of the Services are presented on the Site for informational purposes only and are not contractual. For any details regarding the characteristics of a Service, please refer to the details appearing on the Site.

Jet Systems reserves the right to make any modification it deems useful to its Services at any time, without obligation to maintain the Services previously made available to Customers. Jet Systems also reserves the right to modify its prospectuses or catalogs without prior notice.

Jet Systems reserves the right to modify the prices indicated at any time, without any notice. The price applicable to the Service ordered corresponds to the price displayed on the Site upon final validation of the order by the Customer.

As part of the Panoramic Flight and First Flight offers, E-Tickets are not refundable but remain valid for 12 months from the date of purchase.

Jet Systems nevertheless offers Customers the choice of subscribing to one of the following Options

“ZEN” OPTION SOLD BY E-TICKETBicket in case of loss.

“ZEN +” OPTION SOLD BY E-TICKET

The “Zen +” option allows you to reimburse your E-Ticket in the event of non-use during its validity.

Any reimbursement request is made using a reimbursement form (appearing in Appendix 1) to be completed and sent by registered mail with acknowledgment of receipt to the following address:

Fees incurred for purchasing this option are non-refundable. Only the cost of the flight will be refunded. Reimbursement will be made based on the payment method used.

ARTICLE 4: ORDERS

Once validated, the order will be confirmed by sending an order confirmation to the Customer by email, which will be accompanied by the sending of the General Terms and Conditions in PDF with the invoice for the Services.

4.1 Prior identification of the Customer

4.1.1 Customer already benefiting from a personal account

The Customer who already has a personal account on the Site must identify himself in the part of the Site reserved for this purpose by indicating the email address that he has previously communicated to Jet Systems as well as the password that the latter gives him. assigned.

Once identified, the Customer accesses his personal account and can begin to select the Service(s) he wishes to order. If they lose their password, the Customer clicks on the “Forgotten password?” tab. » and enters their email address. His password will be automatically sent to his email address.

4.1.2 Customer without a personal account

The Customer who does not already have a customer account on the Site and wishes to place a first order on the Site, must complete a registration form online by filling in all the mandatory fields marked with an asterisk.

The Client undertakes to provide fair and sincere information. The information communicated by the Customer when creating this account is binding on the Customer. Jet Systems cannot in particular be held responsible for the impossibility in which it may be able to fulfill its obligations, in the event of an error by the Customer, in particular in the wording of the contact details of the recipient of the order.

Once the form has been completed and validated, the Customer can begin to select the Service(s) they wish to order.

4.2 Placement and confirmation of the order

4.2.1 Choice and availability of Services

The Customer places his order using the Services presented on the Site. It is up to the Customer to select the available Service(s) that they wish to order in accordance with the instructions on the Site.

The Service offers are understood within the limits of the possibility of their realization by Jet Systems in accordance with the indications which will appear on the Site at the time of placing the order.

4.2.2. Shopping cart consultation

Once the Services have been selected, the Customer has the possibility to check the content of his order in particular, the number of Services, the unit price as well as the total price by clicking on the “My Basket” link.

The Basket also allows you to view the Services, as well as all of their characteristics, prices and terms of provision. The Customer will have the possibility to withdraw one or more Services. The order may be modified at any time before its final validation. It will only be definitively registered after providing the various information and paying online.

4.2.3 Order confirmation

Before confirming the order, the Customer clicks on the button “I have read and accept the general conditions of sale”, and thus declares to fully and unreservedly accept this order as well as all of the General Terms and Conditions.

The Customer will finalize his order by making payment. Any validated order constitutes acceptance of the price corresponding to the Services ordered. The order will only be final upon payment of the corresponding price. The Customer guarantees that he is fully authorized to use the credit card to pay for his order and that these payment methods provide access to sufficient funds to cover all costs resulting from orders placed on the Site.

4.2.4 Confirmation of sale by Jet Systems

Once the order has been validated and payment made, the Customer receives an acknowledgment of receipt of their order at the email address they provided. This acknowledgment of receipt sets out the amount invoiced, the list of Services, the deadline and terms of provision, these conditions, as well as the standard withdrawal form (attached).

The Customer acknowledges that the order recording systems constitute proof of the purchase and its date.

4.3 Modification or cancellation of the order

In the event of unavailability of the Service after confirmation of the order by Jet Systems, the Customer will be informed by email of the cancellation of their order. In this case, the Customer has the option (i) to order a Service of equivalent quality and price within the limits of the Services offered, or (ii) to be reimbursed for the price of the Service ordered within 30 days following his request.

Any abnormal or bad faith order, any fraud or attempted fraud, any incident in payment of the price of an order may result in the deletion and/or deactivation of the customer account concerned and/or refusal of the order.

4.4 Proof of order

Computerized records, kept in Jet Systems' computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. Archiving of orders is carried out on a medium reliable and durable.

ARTICLE 5: PRICE

The prices of the Services are indicated in euros, all taxes included (TTC), excluding any processing costs. The amount of processing fees will, where applicable, be calculated automatically based on each order; it will appear on the summary of the Customer's order, before final recording. In addition, once the order has been validated, the prices and costs are confirmed in the confirmation email sent to the Customer.

The Services will be invoiced on the basis of the price in effect at the time of final validation of the order. At no time can the sums paid be considered as deposits or deposits.

If one or more taxes or contributions, particularly environmental, were to be created or modified, either up or down, this change may be reflected in the selling price of the Services.
The prices indicated on the Site may change at any time, particularly in the event of offers or special sales. In the event that the price of a Service is not determined in advance, or when an exact price cannot be indicated, Jet Systems will provide the Customer with a price calculation method or a detailed quote.

ARTICLE 6: PAYMENT TERMS

Payment for orders is made online, by credit card (Visa, MasterCard and other credit cards).
The Customer's bank card will be debited at the time of validation of the order.
The Customer undertakes to have all the necessary authorizations for the use of the bank card intended for payment of the order on the Site.
The Site is subject to a security system: the “Secure Payment” page details the security elements of transactions carried out on the Site.

ARTICLE 7: DELIVERY OF SERVICES – DELIVERIES

The delivery of the Services means their performance by Jet Systems. It will only take place after confirmation of payment by the Jet Systems banking organization.

Jet Systems undertakes to make its best efforts to carry out the services at the time and on the day agreed with the Client. However, these indications may change due to the conditions prevailing on that day and time. If the completion date is postponed for a period greater than five (5) days, for any reason other than force majeure or the Customer's actions, the order may be canceled at the Customer's written request under the conditions provided for in articles L 216-2, L. 216-3 and L. 241-4 of the Consumer Code. The sums paid by the Customer will then be returned to him at the latest within fourteen (14) days following the date of termination of the order, excluding any compensation or withholding.

To benefit from the Services, the Customer must present themselves at the meeting place agreed with Jet Systems 20 minutes before the scheduled takeoff time, with their E-Ticket and, where applicable, with the exchange voucher or the gift voucher concerned.

Jet Systems expressly informs the Customer that the presentation of an identity document is obligatory for any person entering its premises. Without presentation of one or more of these documents, Jet Systems reserves the right to refuse boarding of the passenger on board the helicopter.

Jet Systems also informs the Customer that the circuits presented at the time of booking are subject to change depending on weather conditions.

Jet Systems offers home delivery of gift bags relating to the Services. The shipment is made to the delivery address indicated by the Customer.

Delivery is made by La Poste via Tracked Letter, delivery service with tracking, delivered without signature. Jet Systems may provide the Customer with the tracking number by email.

For purchases of E-Tickets, upon receipt, the Customer will contact the Jet Systems reservation center on 0 892 494 494 (0.40€/min + price of a local call) or by email at info@ jetbooking.fr in order to arrange an appointment to benefit from the purchased Service.

For purchases made on the site of one of Jet Systems' partners, an appointment must be made with the partner concerned. Jet Systems will then validate the Customer's request. Following this validation, an e-mail will be sent to the Customer with an E-Ticket to be presented on the day of the flight (in paper or electronic version).

ARTICLE 8: CANCELLATION OF SERVICES – FORCE MAJEURE

For reasons beyond its control, Jet Systems reserves the right to cancel and/or postpone the Services at very short notice. In this case, Jet Systems will not be liable for accommodation and catering transport costs incurred by the Client to get to the site.

All Customers are informed that the conduct of aerial activities may be modified depending on weather, aerological or technical conditions that could harm the safety of the flight, either by restriction, modification or prohibition of airspace. During a shared flight, a minimum number of passengers is required, it can be 4 or 5 depending on the aircraft. The Customer will be informed as soon as possible of these possible changes.

The parties cannot be held responsible if the non-performance or delay in the performance of any of their obligations, as described in the General Terms and Conditions, results from a case of force majeure, within the meaning of article 1218 of the Civil Code.
Given the nature of the Services offered, the parties expressly agree that any event, particularly meteorological, which calls into question the provision of services under the usual safety conditions will be considered a case of force majeure within the meaning of the provisions of the article 1218 of the Civil Code.

 ARTICLE 9: WITHDRAWAL

The Customer declares to have read the provisions of article L. 221-28, 12° of the Consumer Code, under which the right of withdrawal is in particular excluded for the provision of accommodation services, other than accommodation residential, goods transport services, car rentals, catering or leisure activities which must be provided on a specific date or period.

 ARTICLE 10: LIABILITY – GUARANTEE

Jet Systems cannot be held liable in the event of delay or suspension of the Services for reasons beyond its control or attributable to the Client, as well as in the event of force majeure as defined by article 1218 of the Civil Code.

Jet Systems' liability can only be incurred in the event of fault or negligence on its part, proven by the Customer. In any event, Jet Systems' liability will be limited to certain, direct and personal damage, proof of which has been previously provided by the Customer.

In accordance with applicable legal provisions, Jet Systems provides the legal guarantee of conformity of the Services provided on the Site. Unless expressly agreed in writing with the Customer, Jet Systems does not provide a commercial guarantee within the meaning of the provisions of Article L. 217-15 et seq. of the Consumer Code

ARTICLE 11: PROTECTION OF PERSONAL DATA

As part of the creation of the customer account and the execution of the order, information and data concerning the Customer are collected. In application of law 78-17 of January 6, 1978 amended by law no. 2018-493 of June 20, 2018, it is recalled that this data is necessary for order management and commercial relations. They may be transmitted to companies that contribute to these relationships such as those responsible for the execution of Services and orders for their management, execution, processing and payment.

In accordance with current national and European regulations, the Customer has a right of permanent access, modification, rectification, opposition to portability and limitation of processing with regard to information concerning him.

This right can be exercised by writing to Jet Systems by mail, indicating your surname, first name, email, address and, if possible, your customer reference, to the following address: rgpd@m2h.fr

Information held by Jet Systems cannot be transmitted to a company whose head office is in a country which does not guarantee the same degree of security and confidentiality as that required in the European Union.

The Jet Systems file containing Customers' personal data has been declared to the Commission Nationale Informatique et Libertés (CNIL). The declaration number is [Current application]

 ARTICLE 12: INTELLECTUAL PROPERTY

The content of the Site is the property of Jet Systems and its partners and is protected by French and international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly prohibited and may constitute an offense of counterfeiting.

ARTICLE 13: DISPUTE – APPLICABLE LAW – COMPETENT JURISDICTION

Any complaint must be sent to Jet Systems by registered mail with acknowledgment of receipt within 10 days from the date of completion of the Service giving rise to the dispute. After this period, no complaints will be admissible. Complaints should be sent to:

In the absence of an amicable settlement, the Commercial Court of Romans has sole jurisdiction to settle all disputes between Jet Systems and the Customer, including in the event of multiple defendants, connection or intervention. The General Terms and Conditions and the orders resulting from them are subject to French law.

If one of the clauses or provisions of the General Conditions of Sale is canceled or declared illegal by a final court decision, this nullity or illegality will in no way affect the other clauses and provisions, which will continue to apply.

The fact that Jet Systems does not avail itself of one of the clauses of the General Conditions of Sale at a given moment cannot be interpreted as a waiver of its right to avail itself of it at a later date.
