General terms and conditions of sale
These terms apply to every order placed on jetbooking.fr, published by Jet Systems Hélicoptères Services.
Preamble
Any order placed on the website accessible at www.jetbooking.fr (hereinafter the “Site”), published by Jet Systems Hélicoptères Services, a French simplified joint-stock company (SAS) registered with the Romans-sur-Isère Trade and Companies Register (RCS) under number 342 910 882, whose registered office is at 158 allée de l’Ancien Hippodrome, 26120 Chabeuil (hereinafter “Jet Systems”), is subject to these general terms and conditions of sale (hereinafter the “GTCS”).
Scope
The GTCS apply, without restriction or reservation, to the performance of all services offered on the Jet Systems Site (hereinafter the “Services”) to all of its customers, whether natural persons (adults, or minors accompanied by an adult) or legal entities, acting for purposes outside their commercial, industrial, craft or professional activity (hereinafter the “Customer(s)”).
The GTCS apply to the exclusion of all other terms and conditions, whatever their medium, content or author.
The GTCS set out the entirety of the parties’ obligations. Accordingly, Customers are deemed to accept them without reservation. Placing an order on the Site implies the Customer’s unreserved acceptance of the latest version of these GTCS. As the GTCS may be amended from time to time, the applicable version is the one in force on the date of the order and sent to the Customer by e-mail after confirmation of their order.
The GTCS are easily accessible at any time on the Site and shall, where applicable, prevail over any other version or any other conflicting document.
The Customer certifies, having read and accepted the GTCS, that they are of legal age or hold an authorisation to order the Services offered on the Site.
The Customer certifies that they read the GTCS before finally confirming their order on the Site, and the GTCS are binding upon them in accordance with article 1119 of the French Civil Code (Code civil).

Orders
Once confirmed, the order will be acknowledged by an order confirmation sent to the Customer by e-mail, accompanied by the GTCS in PDF format and the invoice for the Services.
4.1 Prior identification of the Customer
4.1.1 Customer who already has a personal account
A Customer who already has a personal account on the Site must log in to the area of the Site provided for this purpose by entering the e-mail address previously provided to Jet Systems and the password assigned to them.
Once logged in, the Customer accesses their personal account and may begin selecting the Service(s) they wish to order. If the password is lost, the Customer clicks on the “Forgotten your password?” tab and enters their e-mail address. Their password will then be sent automatically to that e-mail address.
4.1.2 Customer without a personal account
A Customer who does not yet have a customer account on the Site and wishes to place a first order on the Site must complete an online registration form, filling in all the mandatory fields marked with an asterisk.
The Customer undertakes to provide accurate and truthful information. The information provided by the Customer when creating this account is binding upon them. In particular, Jet Systems cannot be held liable if it is unable to fulfil its obligations owing to an error by the Customer, notably in the contact details of the recipient of the order.
Once the form has been completed and validated, the Customer may begin selecting the Service(s) they wish to order.
4.2 Placing and confirming the order
4.2.1 Choice and availability of Services
The Customer places their order from the Services presented on the Site. It is the Customer’s responsibility to select the available Service(s) they wish to order in accordance with the information shown on the Site.
Offers of Services are valid subject to Jet Systems being able to perform them, in accordance with the information shown on the Site at the time the order is placed.
4.2.2. Viewing the Basket
Once the Services have been selected, the Customer can check the content of their order, in particular the number of Services, the unit price and the total price, by clicking on the “My Basket” link.
The Basket also displays the Services, together with all their characteristics, prices and terms of provision. The Customer may remove one or more Services. The order may be modified at any time before final confirmation. It will only be definitively recorded once the various details have been entered and online payment has been made.
4.2.3 Order confirmation
Before confirming the order, the Customer clicks on the “I have read and accept the general terms and conditions of sale” button, thereby declaring that they fully and unreservedly accept this order and the GTCS in their entirety.
The Customer will finalise their order by paying for it. Any confirmed order constitutes, in particular, acceptance of the price of the Service(s) ordered. The order will only become final upon payment of the corresponding price. The Customer warrants that they are fully authorised to use the credit card used to pay for their order and that this means of payment gives access to sufficient funds to cover all costs arising from orders placed on the Site.
4.2.4 Confirmation of the sale by Jet Systems
Once the order has been confirmed and payment made, the Customer receives an acknowledgement of their order at the e-mail address they provided. This acknowledgement states the amount invoiced, the list of Services, the timescale and terms of provision, these terms and conditions, and the model withdrawal form (annexed hereto).
The Customer acknowledges that the order recording systems constitute proof of the purchase and of its date.
4.3 Modification or termination of the order
Should a Service become unavailable after Jet Systems has confirmed the order, the Customer will be informed by e-mail that their order has been cancelled. In that case, the Customer may choose (i) to order a Service of equivalent quality and price from among the Services offered, or (ii) to be refunded the price of the Service ordered within 30 days of their request.
Any abnormal order or order placed in bad faith, any fraud or attempted fraud, and any payment incident relating to the price of an order may result in the deletion and/or deactivation of the customer account concerned and/or the refusal of the order.
4.4 Proof of the order
Computerised records, kept in Jet Systems’ computer systems under reasonable security conditions, shall be deemed to constitute proof of the communications, orders and payments made between the parties. Orders are archived on a
reliable and durable medium.
Prices
Prices for the Services are shown in euros inclusive of all taxes (TTC), excluding any contribution to processing fees. Where applicable, the amount of processing fees will be calculated automatically for each order and will appear in the Customer’s order summary before final recording. In addition, once the order has been confirmed, the prices and fees are confirmed in the confirmation e-mail sent to the Customer.
Services will be invoiced on the basis of the prices in force at the time of final confirmation of the order. Under no circumstances may the sums paid be regarded as deposits (arrhes or acomptes).
If one or more taxes or levies, in particular environmental ones, were to be introduced or amended, whether upwards or downwards, this change may be passed on in the selling price of the Services.
Prices shown on the Site may change at any time, in particular in the case of special offers or sales. Where the price of a Service cannot be determined in advance, or where an exact price cannot be given, Jet Systems will provide the Customer with a method of calculating the price or a detailed quotation.
Terms of payment
Orders are paid online by bank card (Visa, MasterCard and other bank cards).
Payments are handled and secured by Société Générale through its Sogecommerce online payment solution: the Customer’s card details are entered on the bank’s secure page and are never passed on to or stored by Jet Systems.
The Customer’s bank card will be debited when the order is confirmed.
The Customer undertakes to hold all the authorisations required to use the bank card intended for payment of the order on the Site.
The Site is protected by a security system: the “Secure payment” page details the security measures applied to transactions carried out on the Site.
Provision of services – deliveries
Provision of the Services means their performance by Jet Systems. It will only take place after payment has been confirmed by Jet Systems’ bank.
Jet Systems undertakes to use its best endeavours to perform the services at the time and on the day agreed with the Customer. However, these arrangements may change depending on the conditions prevailing on that day and at that time. If the date of performance is postponed by more than five (5) days for any reason other than force majeure or an act of the Customer, the order may be terminated at the Customer’s written request under the conditions laid down in articles L. 216-2, L. 216-3 and L. 241-4 of the French Consumer Code (Code de la consommation). The sums paid by the Customer will then be refunded no later than fourteen (14) days following the date on which the order was terminated, without any compensation or deduction.
To enjoy the Services, the Customer must arrive at the meeting place agreed with Jet Systems 20 minutes before the scheduled take-off time, bringing their e-ticket and, where applicable, the relevant exchange voucher or gift voucher.
Jet Systems expressly informs the Customer that presentation of an identity document is mandatory for anyone entering its premises. If one or more of these documents is not presented, Jet Systems reserves the right to refuse to board the passenger on the helicopter.
Jet Systems also informs the Customer that the routes presented at the time of booking may be modified depending on weather conditions.
Jet Systems offers home delivery of gift packs for the Services. They are sent to the delivery address given by the Customer.
Delivery is made by La Poste via Lettre suivie, a tracked delivery service, delivered without signature. Jet Systems may provide the Customer with the tracking number by e-mail.
For purchases of e-tickets, from receipt thereof, the Customer will contact the Jet Systems booking centre on 0 892 494 494 (€0.40/min + cost of a local call) or by e-mail at [email protected] in order to arrange an appointment to enjoy the Service purchased.
For purchases made on the website of one of Jet Systems’ partners, appointments must be made with the partner concerned. Jet Systems will then validate the Customer’s request. Following this validation, an e-mail will be sent to the Customer with an e-ticket to be presented on the day of the flight (in paper or electronic form).
Cancellation of services – force majeure
For reasons beyond its control, Jet Systems reserves the right to cancel and/or postpone the Services, including at very short notice. In such a case, Jet Systems shall not be liable for any travel, accommodation or meal expenses incurred by the Customer to get to the site.
All Customers are informed that air activities may be modified depending on weather, aerological or technical conditions that could compromise flight safety, or due to restriction, modification or prohibition of airspace. For shared flights, a minimum number of passengers is required, which may be 4 or 5 depending on the aircraft. The Customer will be informed of any such changes as early as possible.
The parties cannot be held liable if the non-performance of, or delay in performing, any of their obligations as described in the GTCS results from a case of force majeure within the meaning of article 1218 of the French Civil Code (Code civil).
Given the nature of the Services offered, the parties expressly agree that any event, in particular weather-related, that would jeopardise the performance of the services under the usual safety conditions shall be deemed a case of force majeure within the meaning of article 1218 of the French Civil Code (Code civil).
Right of withdrawal
The Customer declares that they are aware of the provisions of article L. 221-28, 12° of the French Consumer Code (Code de la consommation), under which the right of withdrawal is excluded, in particular, for the provision of accommodation services other than residential accommodation, transport of goods services, car rental services, catering services or leisure activities that must be provided on a specific date or within a specific period.
Liability – guarantee
Jet Systems shall not be held liable in the event of delay or suspension of the Services for reasons beyond its control or attributable to the Customer, or in the event of force majeure as defined by article 1218 of the French Civil Code (Code civil).
Jet Systems may only be held liable in the event of fault or negligence on its part, proven by the Customer. In any event, Jet Systems’ liability shall be limited to certain, direct and personal loss, proof of which must first have been provided by the Customer.
In accordance with the applicable legal provisions, Jet Systems provides the legal guarantee of conformity for the Services supplied on the Site. Unless expressly agreed in writing with the Customer, Jet Systems does not provide any commercial guarantee within the meaning of article L. 217-15 et seq. of the French Consumer Code (Code de la consommation)
Personal data protection
When the customer account is created and the order is performed, information and data concerning the Customer are collected. Pursuant to French Law no. 78-17 of 6 January 1978 (loi Informatique et Libertés), as amended by Law no. 2018-493 of 20 June 2018, Customers are reminded that this data is necessary for order management and commercial relations. It may be passed on to companies that contribute to these relations, such as those responsible for performing the Services and orders, for their management, performance, processing and payment.
The information and data collected are also kept for security purposes, in order to comply with legal and regulatory obligations, and to improve and personalise the services offered and the information sent.
In accordance with the national and European regulations in force, the Customer has a permanent right of access, modification, rectification, objection, portability and restriction of processing with regard to information concerning them.
This right may be exercised by writing to Jet Systems, stating their surname, first name, e-mail, address and, if possible, their customer reference, at the following address:[email protected]

Any reproduction of this content, in whole or in part, is strictly prohibited and may constitute an offence of infringement (contrefaçon).
Disputes – governing law – jurisdiction

Failing an amicable settlement, the Commercial Court of Romans (Tribunal de Commerce de Romans) shall have sole jurisdiction to settle any dispute between Jet Systems and the Customer, including in the event of multiple defendants, related claims or third-party proceedings. The GTCS and the orders arising from them are governed by French law.
If any of the clauses or provisions of the GTCS were to be annulled or declared unlawful by a final court decision, such nullity or unlawfulness shall in no way affect the other clauses and provisions, which shall continue to apply.
The fact that Jet Systems does not at any given time invoke any of the clauses of the GTCS cannot be interpreted as a waiver of its right to invoke them at a later date.
